User Agreement

1. Application

This User Agreement (the “Agreement”) sets forth the legally binding terms and conditions for your use of the Services provided by LIIO Intelligence AB, org.nr 559278-5496 (“LIIO or We”).

2. Definitions

"User" - Refers to an individual person who registers a LIIO Account.

"License" - Refers to the right to use and access the LIIO Account application.

"Account" - Refers to the User's login to the LIIO Account, from which the User can control and interact with the companion robot, view historic information and data, update payment methods and user details, etc.

“Services” means the use of the LIIO companion robot and the LIIO App and its related services made available through the Website or the LIIO App, together with any other related equipment services, and information made available by LIIO.

3. Register an account

When you purchase your LIIO companion robot a user account for the LIIO Account is automatically created as this is a prerequisite for the use of the companion robot.

Each companion robot can only be connected to one account, but each User can have several connected companion robots.

4. Conditions for use

All use of the LIIO services is conditional upon you as the User accepting this User Agreement, which you also confirm when you purchase your companion robot and the account is created.

You can stop using the service at any time and deactivate your LIIO Account. Please note that if you deactivate your LIIO Account you will no longer be able to use your companion robots cloud services. These conditions apply for as long as there is an active user account.

5. Use of the service

As a User, you are responsible for all use of the Service and for your login information to be protected from unauthorized access. It is not allowed to transfer or allow someone else to use your account. You agree to notify LIIO immeadiately of any unauthorized use of your account or password or any other breach of security.

By accepting this User Agreement, you warrant that you will not use the Service for any purpose that violates applicable laws or otherwise may cause harm or inconvenience to LIIO or any third parties.

You are responsible for following applicable local laws and regulations. LIIO cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.

6. Compliance with local laws and regulations

In addition to what has been stated above, you agree to at all times use the Services in compliance with any locally applicable laws, regulations and rules. You understand that you are solely responsible and liable for any violation of any laws, regulations and rules in relation to Your use of the Services.

7. The services

Through your LIIO Account you are always in direct contact with your companion robot as the LIIO companion robot uses Wifi network to stay connected at all times.

The LIIO Account app on your mobile is the control device to your companion robot.

Through the LIIO Account app you can follow your companion robot in real-time on the built-in map. Adjust settings for lights and sounds. Give friends and family permission to unlock and drive your companion robot (and configure the maximum top speed for each driver).

Wherever you are you will receive push notifications if your companion robot detects a condition that triggers an event for one or more of the functions you have enabled, e.g. "Watchdog".

8. Price and Payment Terms

When purchasing the companion robot, connection to cloud services is included throughout the product's lifetime. LIIO Intelligence AB guarantees this access free of charge for completed purchases while this agreement is valid.

9. Processing of personal data

When you register a LIIO Account User Account, LIIO will process your personal data in order to provide the Service and to fulfill our obligations according to this Agreement. All personal data will be processed in accordance with our privacy policy.

By entering this User Agreement you confirm that you have acknowledged and agree that LIIO will collect Wifi data, such as the SSID, network strength and your phone identifiers continuously in order to provide our services.

We ask that you read the privacy policy carefully so that you understand how LIIO uses and processes your personal data.

10. Updates and further development

LIIO plans to continuously develop, update and improve the LIIO services.

All further development is included as part of the purchase and the use of new functionality shall be in accordance with this User Agreement, unless LIIO informs that the new functionality requires special conditions.

11. Intellectual property rights

All copyrights, trademarks, company names, logos and other intellectual or industrial property rights owned and used by LIIO as well as those contained in the LIIO app or on the Website (including headings, graphics, symbols, scripts, source codes, etc) is LIIO's property or licensed property of a third party and may not be reproduced, distributed, sold, used, modified, copied, restricted or used (in whole or in part) without prior written consent.

You may not modify, attempt to gain unauthorized access to, alter, infringe on, repair or otherwise alter any of LIIO's software, source codes or information for any purpose.

The LIIO App, Website and companion robots may only be used for purposes consistent with this Agreement.

You agree that the Services and other information, including all related intellectual property rights, provided and made available by LIIO will always remain LIIO's exclusive property and that you may not in any way use LIIO's exclusive rights for commercial or other purposes without LIIO’s prior written consent.

12. Limitation of liability

LIIO intends to keep the services available at all times. However, we cannot guarantee the availability of the service and cannot be held liable if the service is down or if any functionality does not work as expected.

For the avoidance of doubt, LIIO shall under no circumstance be liable for damages caused by substandard or lack of maintenance of your companion robot or consumable parts, etc.

The total liability of LIIO, for all claims under these terms, including for implied warranties, shall be limited to the amount paid by the Customer for the use of the Service.

Under no circumstances shall LIIO be liable for any loss or damage that is not reasonably foreseeable.

13. LIIO’s right to suspend Users

LIIO reserves the right to unilaterally decide to suspend Users from use of the Service.

Suspension may occur, for example, as a result of a violation of these terms and conditions or if the service is used in a manner that may cause LIIO or any third party damage. Suspension can be made without prior notice.

15. Amendments and additions

LIIO reserves the right to change these terms from time to time. The up-to-date terms are always published on our website.

16. Governing Law and Dispute Resolution

Any dispute concerning the application or interpretation of these terms of purchase shall be finally settled by the Swedish general courts in accordance with Swedish law.

The dispute may also be resolved by the Swedish National Board of Consumer Disputes (Sw: Allmänna reklamationsnämnden) or by using the European Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr).
